Glentana Village Land Use Contract Rezoning
The Province of British Columbia (the Province) has legislated that all land use contracts will terminate by June 30, 2024. In the Town of View Royal, this affects the land use contract that applies to the area known as 'Glentana Village'. The Town of View Royal will be replacing the Glentana Village Land Use Contract with new zoning regulations.
Background
When the Town of View Royal was an unincorporated electoral area of the Capital Regional District, CRD Bylaw 421 [PDF - 4 MB] was adopted on February 8, 1978 to enter into a land use contract for development of the following lands:
- 1500 Glentana Road
- 1501 Glentana Road (Cameo Housing Co-operative)
- 1507 Glentana Road (Glentana Village Recreation Centre)
- 1611, 1615, 1617, 1619 and 1621 Glentana Road
- Properties on Falstaff Place, Ethos Place, Amber Place and Demos Place
- Part of Portage Park

Development on the Glentana Village Land Use Contract lands included detached dwellings (fee simple, bare land strata, and condominium strata), townhouses, maisonettes (also known as stacked townhouses), a housing cooperative and a private recreation centre.
What are land use contracts and why are they being terminated?
Land use contracts were used in the 1970s as an alternative to zoning to regulate building construction and design, parking, landscaping, etc. on large development sites. Over time they were found to be inflexible for things such altering or reconstructing buildings and the legislation to enable them was repealed in 1978. They have since been replaced by other tools such as development permits, development cost charges, density bonusing, and phased development agreements. The Province has changed legislation so that all land use contracts in British Columbia will terminate by June 30, 2024.
Why are the lands in the Glentana Village Land Use Contract area being rezoned?
The lands in the Glentana Village Land Use Contract area do not have zoning designations because the land use contract included development regulations that have remained in effect since 1978. With the upcoming termination of the Glentana Village Land Use Contract in 2024, the Town of View Royal is now responsible to implement zoning in this area.
What does this mean for the property that I own or live on?
The intent is to enact zoning regulations for this neighbourhood that would follow the provisions of the Glentana Village Land Use Contract as much as possible.
- If a building or other structure built in accordance with the Glentana Village Land Use Contract would not comply under the new zoning regulations, it can still be maintained and repaired under certain conditions.
- If land, a building or other structure is being lawfully used under the Glentana Village Land Use Contract and the use would not apply under the new zoning regulations, the use may continue as a non-conforming use under certain conditions.
